These Membership Terms & Conditions form a legally binding agreement between you (“the Member”) and Factory Gym (Swansea) Ltd (“we”, “us”, “our”).
By completing your membership registration and ticking acceptance of these Terms, you agree to be bound by them.
1. Membership Agreement
1.1 Your membership contract is with Factory Gym (Swansea) Ltd.
1.2 Your membership commences on the date agreed at sign-up.
1.3 By accepting these Terms, you confirm that all information provided during registration is accurate and complete.
1.4 These Terms, together with your membership agreement and pricing plan, form the entire agreement between you and us.
2. Membership Fees & Payments
2.1 Membership fees are payable in advance as agreed at the time of joining.
2.2 Payments are collected via our authorised payment provider.
2.3 If a payment fails, we reserve the right to suspend access to the gym until outstanding amounts are cleared.
2.4 You are responsible for ensuring your payment details remain valid and up to date.
2.5 We reserve the right to review and adjust membership fees upon giving reasonable notice.
3. Minimum Term & Cancellation
3.1 If your membership includes a minimum term, you agree to remain a member for that minimum period unless cancellation is permitted under these Terms.
3.2 After the minimum term, your membership will continue on a rolling basis unless cancelled in accordance with these Terms.
3.3 You may cancel your membership by providing notice via the method specified at sign-up.
3.4 A statutory 14-day cooling-off period applies from the date you join online. If you cancel within this period, you may receive a refund, subject to deduction for any days used.
3.5 We may cancel or suspend your membership if you breach these Terms or act in a manner that endangers others or damages the reputation of the gym.
4. Access & Use of Facilities
4.1 Access is permitted only to the registered Member. Membership is non-transferable.
4.2 You must comply with all gym rules, signage, and staff instructions at all times.
4.3 We reserve the right to close the gym or restrict access temporarily for maintenance, repairs, cleaning, events, or circumstances beyond our control.
4.4 No refund or compensation will be given for temporary closures where reasonable notice is provided, except where required by law.
5. Member Conduct
5.1 You must behave responsibly and respectfully towards staff and other members.
5.2 You must:

Wear appropriate, clean training clothing and footwear

Re-rack weights and return equipment after use

Use equipment only for its intended purpose

Follow all safety instructions
5.3 You must not:

Use the gym under the influence of alcohol or drugs

Engage in aggressive, abusive, or dangerous behaviour

Damage equipment intentionally or through misuse
5.4 We reserve the right to suspend or terminate membership for serious or repeated breaches.
6. Health, Safety & Induction
6.1 You must complete any health declaration and/or Physical Activity Readiness Questionnaire (PAR-Q) honestly before commencing training and must inform Factory Gym (Swansea) Ltd immediately of any medical condition, injury, or change in health that may affect your ability to exercise safely.
6.2 If you answer “YES” to any health question, you may be required to obtain medical clearance from your GP or a qualified healthcare professional before participating in any training or activity at the gym.
6.3 You acknowledge and understand that Factory Gym is a strength-training and bodybuilding facility where heavy free weights, resistance machines, and high-intensity training are regularly undertaken. Participation in such activities involves inherent risks of injury, which cannot be entirely eliminated.
6.4 If you are inexperienced, not confident using gym equipment, or unsure how to train safely, you must request a gym induction before commencing exercise.
6.5 If you decline an induction, you confirm that you are competent to use gym equipment safely and accept full responsibility for ensuring that you use all equipment correctly and safely.
6.6 If at any time you are unsure how to use equipment safely, you must stop immediately and seek assistance from a member of staff before continuing.
6.7 Except where caused by our negligence or breach of legal duty, participation in activities and use of facilities is undertaken at your own risk.
7. Personal Property
7.1 You bring personal belongings into the gym at your own risk.
7.2 Except where caused by our negligence or breach of legal duty, we accept no responsibility for loss, theft, or damage to personal property.
7.3 Lockers are provided for convenience only and do not imply acceptance of liability.
8. Liability
8.1 Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under the laws of England and Wales.
8.2 Subject to Clause 8.1, we shall not be liable for indirect or consequential loss arising from your use of the facilities.
9. Data Protection
9.1 Factory Gym (Swansea) Ltd processes personal data in accordance with UK GDPR and the Data Protection Act 2018.
9.2 We collect personal data necessary to administer your membership, including contact details, payment information, attendance data, and relevant health information provided in your PAR-Q.
9.3 Health information is treated as special category data and processed for the purposes of health, safety, and contractual performance.

10. Changes to Terms
10.1 We reserve the right to update these Terms where reasonably necessary for legal, regulatory, or operational reasons.
10.2 Members will be notified of material changes.
11. Governing Law
11.1 These Terms are governed by the laws of England and Wales.
11.2 Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Except where caused by our negligence or breach of legal duty, we are not responsible for any theft, loss, damage or destruction of your property or belongings while using our facilities.
